Last Updated: September 9, 2025

Introduction

Acttalk.com (“we,” “us,” “our”) respects the intellectual property rights of others and is committed to full compliance with the Digital Millennium Copyright Act (“DMCA”). This policy outlines the procedures for copyright owners to report alleged infringement of their works on our website, Acttalk.com (the “Website”), and for our users to respond to such notices.

Notice of Copyright Infringement

If you are a copyright owner or an authorized agent thereof and believe that any content hosted on our Website infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Designated Copyright Agent with the following information in writing:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., the URL of the page where the material is located).
  4. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please send the completed DMCA notice to our Designated Agent. Failure to include all of the above information may result in a delay in processing your complaint.

Takedown Procedure

Upon receipt of a valid DMCA notification, Acttalk.com will:

  1. Act expeditiously to remove or disable access to the allegedly infringing material.
  2. Promptly notify the user or content contributor who posted the material that we have removed or disabled access to it.

Counter-Notification Procedure

If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may file a counter-notification with our Designated Agent. A valid counter-notification must include the following:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside of the United States, for any judicial district in which Acttalk.com may be found), and that you will accept service of process from the person who provided the original infringement notification or an agent of such person.

Upon receipt of a valid counter-notification, we will forward a copy to the original complaining party. If we do not receive notice within 10-14 business days that the original complaining party is seeking a court order to prevent further infringement of the material, we may, at our sole discretion, replace or re-enable access to the material.

Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Acttalk.com has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. We may also limit access to the Website and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Designated Copyright Agent

All notifications of claimed copyright infringement and counter-notifications should be sent to our Designated Copyright Agent:

Designated Agent: Copyright Compliance Department, Acttalk.com
Email: editorial@rcopa.com

Please be aware that you may be held liable for damages (including costs and attorneys’ fees) if you materially misrepresent that a product or activity is infringing your copyrights. Accordingly, if you are not sure whether material available online infringes your copyright, we suggest that you first contact an attorney.
